What is compliance?

October 13th 2013 the FCC passed new regulations prohibiting the automated dialing of cell phones with express written consent. It also prohibited automated dialing of land lines with written consent.

So, I can just use Preview dialing or Manual Dial on my current Automated Dialer right?

NO. The TCPA expressly prohibits the dialing of cell phones from any SYSTEM that has the ABILITY TO DIAL PREDICTIVELY. It is not good enough to just change your campaigns, you must have a DIFFERNT SYSTEM THAT CANNOT DO AUTOMATED DIALING!

What are the penalties?

Up to a $5000.00 fine FOR EACH VIOLATION

What is Express Written Consent?

It means you must have a SIGNED document stating a customer has given you permission to call them

How do I know if my current provider is using different systems for cell phones and land lines?

YOU DON'T! Don't listen to anyone who tells you they have legal opinions that what they are doing is ok. If you're provider is not being 100 percent transparent about how they handle different SYSTEMS...YOU ARE AT RISK!
